New developments in a story reported first by Channel Six News two weeks ago. A 13 year old boy accused of participating in the sexual assault of a five year old girl has been ordered back into detention.
A juvenile court judge ruled the young suspect is a danger to the neighborhood where he and the victim both live.
The victim’s mother and father are relieved after attending the detention hearing in Douglas County Juvenile Court. The neighborhood near 108th and Blair High Road in northwest Omaha had been alerted by posters that the boy had been home in his parent’s custody since the incident in mid June.The victim’s mother told Channel Six Reporter Mike McKnight, “Everybody was watching this kid but it doesn’t matter he’s still a danger and one moment when somebody isn’t watching this could happen again.”
However the attorney for the 13 year old defendant is Steve Lefler and he said his client has no record and comes from a good family. Lefler said, “He is absolutely no risk and even if the worst is imagined of him his parents have done everything can to make sure he can’t expose to any kids at all.”
However Judge Wadie Thomas ruled the 13 year old is a danger to the neighborhood.
A 12 year old accomplice had been ordered back to detention a week ago. He’s in protective custody. Lefler said about his 13 year old client. “He is peeing his pants, he is so nervous about going to a place with 17 and 18 year old kids who are hardened and rough.”
Lefler argued his client was paid by the 12 year old to participate in forcing the five year old neighbor girl to perform oral sex on them and her then six year old brother or her brother would be beaten up. The sexual assault occurred in a culvert near the Avalon neighborhood park.
